(Video updated) The 13-year-old boy accused of robbing and assaulting Mitchell Wilson was found not guilty.

The judge says the crown could not prove beyond a reasonable doubt the accused, who cannot be named, was the one who attacked Wilson in Pickering in November 2010.

Wilson took his own life last fall – one day before he was supposed to face the teen in court. Last month it was ruled that his statements to police and his stepmother could be used in court. His statements identified an older 13-year-old boy as one of two people who jumped and robbed him while he was out walking in his neighbourhood.

Wilson, who suffered from muscular dystrophy, killed himself last September, the day he was subpoenaed to testify in the case. His parents said he was being bullied.
