Tax dispute on Caledonia land

The former owners and developers of the site of Caledonia’s native land occupation are back in court.

Don and John Henning are fighting a re-assessment by the Canada Revenue Agency on the $15.8 million the Ontario government paid them in 2006. That’s when protesters from Six Nations occupied the land they were building houses on.

Henco (the development company) and the Hennings were taxed on the money the province paid them for the land. Then the province issued a moratorium on all development on that land, and a notice of assessment deemed the land to be worthless.

The Hennings are appealing the amount of taxes they paid based on the re-assessment.
