Robert Badgerow’s wedding video played in court

Robert Badgerow’s thank you speech at his 1982 wedding was played for jurors at his murder trial today. It’s a precedent-setting fourth trial on the same charges; the 1981 rape, strangulation and drowning of Diane Werendowicz in east Hamilton. The crown finished presenting evidence last week and now Badgerow’s lawyer is arguing his side.

The video shows Robert Badgerow the day he married Tammy Hunt in 1982, they broke up a few years later. The video was first played in court yesterday for Tammy Hunt’s little brother, Robert Hunt, who was 17 when it was recorded. Hunt does not think it is Robert Badgerow’s voice on the 911 call. The call was made two days after Werendowicz was found and included details only the killer would know. It was traced back to a phone booth near the spot Robert Badgerow worked at Dofasco. But Hunt also agreed with the crown; at least one expression on the 911 tape sounded like Badgerow, “and, uh.”

The audio from the wedding was played again today in court for a former Dofasco friend, another who does not think that’s Robert Badgerow on the 911 call. He could not tell who was speaking when he heard Badgerow’s wedding speech either.

The jury also saw a photo of Brian Miller from 1981, as the testimony of his former girlfriend was read in by lawyers. Miller was a sex offender who, yesterday, described the horrifying crimes he did commit from 1986-91. Murder was not among them he said. Miller worked at Stelco, not Dofasco, where the 911 call was made. But Miller’s girlfriend thought she recognized Miller’s voice when she heard the 911 call.

A forensic toxicologist said today that Werendowicz had the equivalent of three beer in her blood when she died, two or three less than she drank that night. It would have taken her body time to eliminate the others, time Badgerow says was spent with him, in his car, smoking a joint and having sex.

The trial resumes tomorrow.
