The mother of a toddler is demanding to know who killed her son. Noah Keizer died of blunt force trauma to the head in July of 2012. Hamilton Police arrested and charged his babysitter, 28 year old Greg Dalley with Noah’s murder. But last month, a Hamilton jury found him not guilty. Noah’s mother, Nicole Agnew says she was restricted from saying anything during the trial, but now says she wants to be heard.
Agnew was not in court on the day Greg Dalley was acquitted, apart from the day she testified, she stayed well away from the trial. But when a social worker called and told her the verdict was “not guilty” she was staggered. “I felt so sick. All I did was cry. All I did was mope around. I felt so… I felt so defeated.”
She blames the justice system for choosing a jury in the first place for a homicide, “they don’t have any expertise. They’re just random people.” And she is also critical of the police. “I think they should have done better. I think they should have been more thorough..”
She blames Greg Dalley, LaSaundra Grey and Ashlynn Kushuba, the 3 people who were with Noah on the night he died. Neither Grey, nor Kushuba was considered a suspect by police. Investigators never took DNA samples from either woman, nor collected any of the clothing that they were wearing on the night Noah died and neither one was ever charged in connection with his death.
During the trial, Agnew testified that she had never seen Dalley angry or impatient with her son, in fact she told the jury ” I know Greg loved Noah.” If she now feels that Dalley was truly responsible, why did she say such positive things about him, in court? “Cause he was a positive person in my life. But ya, that may be how it seems but it’s not how I feel. He’s a wolf in sheep’s clothing, and everyone’s a fool to think that he’s any different.”
Dalley says the verdict confirms what he has maintained all along, “I was innocent from day one. It’s just unfortunately I had to go through all this to prove my innocence.”
The crown’s request for an appeal has been dismissed. Greg Dalley is a free man. No one has been arrested for killing Noah Keizer and it’s unlikely that anyone will be. When asked the current status of the investigation into noah’s death Hamilton Police issued this statement: “The Hamilton Police service investigated the death of Noah Keizer. Noah’s death was determined to be a homicide and charges were subsequently initiated against Mr. Greg Dalley. Mr. Dalley was found not guilty by a jury. In Canada we cannot question the decision making process of a jury. There are no further persons to be investigated as it relates to the death of Noah Keizer.”
