The prosecution has wrapped it’s case against Greg Dalley, the man accused of killing two year old Noah Keizer in July of 2012. The final witness who was called today was Sgt. Richard Fioriani with the Hamilton Police forensics unit. One of the pieces of evidence shown today is a video shot inside the apartment at 514 King St. E., where Noah Kiezer spent his last few hours. The police video was taken the day after the little boy’s death. It is a look inside the apartment where Noah lived with his mother, Nicole Agnew – it is also where Greg Dalley was babysitting Noah that night while his mom was at work.

Over the last two weeks the jury has heard that Noah Kiezer was likely injured sometime after 8:30 on July 13th. A forensic pathologist said his injuries were consistent with a “forceful slap” to the head – and that the blow likely caused Noah to fall, hitting his head once again. The video shows a 10 centimeter dent in the wall, which the prosecution referred to many times. Official cause of death was blunt force trauma to the head.

The video also shows the makeshift bed in the living room where Noah spent the evening, after the injury. A nest of blankets, with a couch cushion supporting his head. There were no beds in the apartment. That’s where Noah was when neighbour Ashlyn Kashuba says she noticed that he had blood and bruising on his face. She was told that Noah had hurt himself, possibly for attention. The video also shows the kitchen where Gred Dalley, Ashlyn Kashuba, and another neighbour, LaSandra Grey, cleaned the blood from Noah’s face. Defence lawyer Greg Leslie has suggested that it was LaSandra Grey, not Greg Dalley, who hit Noah. After Noah was cleaned up, he was put back to bed in the living room.

While Noah lay, slowly dying, the 3 adults went on the balcony and talked about going out drinking later that night. Ashlyn Kashuba testified that when she left the apartment, Noah was snoring.
He never woke up.
