Musgrave jury deliberating

The jury is now deliberating the fate of two men charged with the murder of 18-year old Brandon Musgrave. As Lisa Hepfner reports, they were charged by the Judge Thursday morning shortly after the crown summed up her case.

The crown says evidence from 53 Dundurn doesn’t prove whose bullet killed Brandon Musgrave. But she says it doesn’t matter.

27-year old Tyrone Chambers and 25-year old Joshua Warner both brought loaded handguns to the March break party in 2010.

On the stand, Chambers testified he didn’t shoot his gun at all that night, but the crown noted several party goers said they saw his gun go off. He had it wrapped in a black sock and investigators found three black socks with bullet holes in them at his apartment on Herkimer Street. Chambers said those were different socks.

Warner didn’t testify, he relied on witnesses. He agrees he should be found guilty of aggravated assault because he did shoot Ted Tsibu-darko in the arm. But he says Chambers shot Kauner Chinambu in the chest and fatally shot 18-year old Brandon Musgrave in the head.

Security footage shows friends Musgrave and Chinambu on the porch at the party before the violence. Neither was involved in the argument when Chambers insisted someone change the music coming from an iPod; although Musgrave did try to diffuse the situation when he saw the guns.

But the crown says regardless of which bullet caused what harm, both men are guilty of second degree murder, because she says, they were acting as one.

The longtime friends arrived together, as the video shows. Warner backed him up every time Chambers started an argument. And after the shooting, they were caught on camera fleeing together down Dundurn Street.

Only one gun was found. Tossed into a yard on Canada Street. It matched three bullets found at the scene and others found stored in Chambers’ girlfriend’s closet.

The crown said she couldn’t rationalize a murder over music except from the perspective of the type of people who carry loaded firearms to a March break student party. Tyrone Chambers admitted to dealing crack and was asked on the stand whether he provided drugs to Rob Ford.

The jury has ended deliberations for the evening and will begin again on Friday morning.
