This could be the last week of evidence at Robert Badgerow’s historic fourth trial for the murder of Diane Werendowicz in 1981. Much of the evidence was heard at three earlier trials on the same charges; they ended either overturned on appeal, or with a hung jury.

In 1998 Hamilton police asked Tim Bradshaw to listen to a suspicious 911 call that contained details of Diane Werendowicz’ murder only the killer would know. Tim Bradshaw’s best friend in the 80s was Brian Miller. Miller testified last week that he did not kill Diane Werendowicz, although he did commit a series of violent rapes during the same era and served time for them. Bradshaw was in the car for one incident in Hamilton, he dropped Miller off to chase after a girl. When he picked him up again later, Miller said he’d had sex in the elevator. Bradshaw thought it had been consensual, he learned otherwise when Miller was convicted. So he knew during this interview police were interested in Miller.

Later the jury heard from another forensic pathologist who reviewed Werendowicz’ death investigation. Robert Badgerow’s lawyers have suggested he had anonymous, consensual sex with Werendowicz after she left the bar, before going home and that she must have been killed by someone else. Lawyers asked what it meant that she was found with her sweater off and her shirt unbuttoned; her jeans on but un-zipped, semen on the crotch but none on her panties, found near her shoes in the brush. The pathologist could only speculate based on sexual assaults he’s studied.

Robert Badgerow himself is expected to testify this week, he’s the last witness to be called.
