Final arguments in the Bosma trial

Dellen Millard had no idea Mark Smich was bringing a gun to the Tim Bosma test drive. If he had been planning a murder, he would have made better plans and covered his tracks. That’s what the jury heard today as Dellen Millard’s lawyer wrapped up his closing arguments to the jury.

Millard’s lawyer, Ravin Pillay said Smich’s version of events don’t make sense. He said Smich clearly concocted his story after hearing the evidence presented by the crown. Dellen Millard didn’t act sketchy or cover his face or tattoos when he met Tim Bosma in his driveway, according to Bosma’s wife and tenant. His co-accused Mark Smich wore a hoodie over most of his face, that’s because Smich was hiding a gun and Millard didn’t know it, his lawyer told the jury.

Most of Millard’s circle knew he planned to steal a Dodge 3500. He didn’t delete any browsing history or turn off his phone before the test drive and Millard scrambled to keep people away from the hangar after the murder, instead of planning it in advance. And he left Tim Bosma’s truck in his mother’s drive, what kind of plan is that? His lawyer asked.

Bosma couldn’t have been killed in this field or someone would have heard it, Pillay says. Police would have found forensic evidence. Why would Dellen Millard spent $22 000 on a machine and risk killing someone, for a used truck worth $24 000? It doesn’t make sense, Pillay said. Millard promised Smich a Cadillac if he helped steal the 3500 and Smich was desperate for that to happen soon. He didn’t want the scoping mission to end without a theft.

Pillay warned the jury he would not have another chance to address them, even if the other two lawyers make arguments he has a good answer for. Tomorrow we will hear closing arguments for Mark Smich, and on Thursday the crown. Next week the judge will give instructions to the jury and they will start deliberations
