A Hamilton construction company has been fined $170,000 for a violation of the occupational health and safety act following a worker’s fatal injury.
McNally Construction faces the fine for an incident in September 2011. A worker had been servicing a battery-powered locomotive, but the vehicle unexpectedly moved forward, fatally crushing the worker’s head between the battery and part of a gantry.
The Ministry of Labour found the gantry was not safe for use with the locomotive supplied.
