Niagara police have upgraded charges against a 55-year-old man, after a fight at a Niagara Falls motel last month led to another man’s death.
Officers say a fight broke out at a motel parking lot in the area of Montrose and Chippawa Creek Roads on June 27, involving two men: 55-year-old Gerald Philion, and a 57-year-old.
Investigators say the 57-year-old had suffered a traumatic head injury and was transported to an out-of-region hospital to be treated.
Philion was arrested and initially charged with aggravated assault.
The 57-year-old man remained in hospital until he died from his injuries on Oct. 22.
Philion appeared at a courthouse Wednesday where his charge was upgraded to manslaughter.
He remains out of custody on a release order pending future court dates.
