Canada’s top court gives go-ahead for Uber lawsuit

A decision by the Supreme Court of Canada means Uber drivers can continue their fight to be recognized as employees.

The high court upheld an earlier Ontario Court of Appeal ruling giving the green light for a class-action lawsuit.

David Heller is the Ontario UberEats driver behind the $400 million suit.

He argues that Uber drivers are employees not independent contractors, and as such are entitled to protections under Ontario’s Employment Standards Act.

That includes things like minimum wage, vacation pay and other benefits.

Heller estimates he earns between $10 and $12 an hour, while the minimum wage in Ontario is $14 an hour.
