Gun sentence going to Supreme Court

The federal government is expected to file an appeal to the Supreme Court of Canada after Ontario’s top court struck down mandatory minimum sentences for gun possession saying they are unconstitutional. The sentence for possessing a loaded prohibited gun was enacted in 2008 as part of the federal conservative government’s omnibus crime bill. The court found a three-year prison sentence for a first offence of the gun crime is “cruel and unusual punishment” saying there can be a “cavernous disconnect” between the severity of such an offence and the severity of the sentence.
