Lawyers for the surviving Boston Marathon bombing suspect are going to discuss the timeline and procedure for prosecutors to decide whether to seek the death penalty.

20 year old Dzhokhar Tsarnaev isn’t expected to be at today’s hearing. U.S. Attorney General Eric Holder will ultimately make the decision about whether to seek the death penalty.

Tsarnaev is accused in the twin bombings that killed 3 people and injured more than 260 others near the finish line of the marathon in April. He’s also accused of killing an M.I.T. police officer three days later.
