A Hamilton pediatrician is behind bars tonight after losing his appeal of a sexual assault conviction involving a teenager. In 2013, Dr. Dan Marshall was found guilty of inappropriately touching a teenage boy who was not one of his patients. On Thursday, Ontario Court of Appeal judges dismissed his appeal of his conviction and sentence.

Marshall had been sentenced to 8 months behind bars less 6 days already served in pre-trial custody. The appeals court did not allow fresh evidence to be submitted, finding it would be unlikely to have affected the outcome. During the original trial, Marshall was acquitted of other sexual assault and sexual interference charges involving 20 of his former patients.

At his 2013 sentencing hearing, Marshall was further charged with 2 counts of sexual assault and 1 each of sexual exploitation and sexual interference brought forward by former patients. Pre-trial motions in that case are scheduled to start October 19th.

An Ontario College of Physicians disciplinary hearing is scheduled for November. If the panel finds Marshall has committed professional misconduct his licence could be suspended or revoked.
