Your liability as a party host

The law is clear as to legal liability of a person caught driving while impaired. But what about the legal obligations of the people who served that person a drink?
Remember the ‘good old days’ when the only thing party hosts had to worry about was having plenty of ice, mix and of course alcohol.
Well, those days are long gone.
Tough, drinking and driving laws, coupled with increased societal pressure mean party hosts have greater responsibility and increased liability to ensure their guests get home safe and sound.
Nancy Swietek, Dan Lawrie Insurance: “The courts can determine that the homeowner is going to be legally liable so that’s why a prudent reasonable person should take every action possible to make sure that if they are hosting any type of party that they are not allowing their guests to leave under the influence of alcohol.”
Bars and restaurants will be packed tonight as party goers ring in the new year. But managers say ensuring their customers get home safely is a year round commitment.
Gerard Wogan, General Manager, Slainte Irish Pub: “Well it’s a continuous thing 365 days a year. We have security on busier nights. Staff are all smart, trained, and tonight I’ll remind them again that people are out to have a good time but you need to keep an eye on them. If necessary, slow down people, slow down the service of drink, offer water and coffee to stop them from over consuming.”
And of course the best way to ensure both you and your guests have a safe and happy new year is to plan ahead and leave your car at home. Happy new year everyone.
