An investigation has cleared a Halton police officer after he shot a man in Burlington last month.

The 34 year old man who was shot, later died.

The province’s Special Investigations Unit is called in any time there is an officer involved injury or death.

The provincial police watchdog says after interviewing dozens of civilian witnesses, and watching cell phone video, they’ve determined the officer was justified in shooting the man.

The officer pulled over a car that was seen driving erratically and going the wrong way on streets.

Investigators say the driver got out and advanced toward the officer shouting and ignoring the officers commands to stay back.

The man grabbed the officer by the neck and punched him, despite being pepper sprayed.

The man then grabbed the officer’s baton and that’s when the officer fired one shot.
