Closing arguments were heard Monday at the trial of Peter Khill. He is charged with second-degree murder in the shooting death of Jon Styres, who was allegedly trying to steal his truck from his Binbrook driveway.
28 year old Peter Khill admits he killed Jon Styres with 2 shot gun blasts, but has pleaded not guilty to the murder charge testifying he fired in self defence, saying he believed 29 year old Styres was pointing a gun at him and that his military training kicked in.
The crown says this never should have happened, saying Khill should have just called 911 when he saw someone breaking into his truck, calling for the jury to find him guilty of second degree murder.
The crown arguing that when Khill yelled “hey hands up” he startled Styres and the minute he started to turn around Khill pulled the trigger saying it was likely Styres was bent over or even on his knees when he was shot again.
Styres is a Six Nations man. Defence lawyer Jeff Manishen told the jury that race plays no part in the case. That Khill would not have known Styres was Indigenous given how dark it was and how fast it all happened.
The judge started his charge to the jury Monday afternoon and will continue Tuesday morning. Then the jury will start its deliberations.
